packing, manuals, registration forms and accessories or you will be subject to a
minimal 20% restocking fee.

WHAT IS THE DURATION OF
YOUR CHOWBIG LIMITED WARRANTY?
LIMITED WARRANTY
INCLUDING LABOR AND PARTS FOR THE FIRST YEAR
ChowBig warrants to the original
purchaser that the ChowBig product or products you have
purchased from ChowBig, excluding software, disks and drivers,
compact discs, documentation, and related information, is free from defects in
parts and/or workmanship for three years from the date of purchase. During the
first year of the warranty period ChowBig will correct any
defects in parts and workmanship at no charge for labor and materials. You must
return the product or products which are defective as explained below. You are
responsible for shipping and insurance expenses incurred in returning the
defective product or products.

This limited warranty does not warrant or cover:
Products not purchased from ChowBig ; Software, disks and
drivers, compact discs, documentation and related information (Please refer to
the software publisher's warranty); Damage during shipment other than original
shipment to purchaser; Impact with other objects, dropping, falls, spilled
liquids, or immersion in liquids; Disaster such as fire, flood, wind,
earthquake, or lightning; Unauthorized attachments, alterations, modifications
or foreign objects; Peripherals (components used with ChowBig
products but which are not sold by ChowBig to
purchaser); Problems resulting from adjustments to the purchased hardware and
software configuration and additional hardware and software; Problems caused by
configuration conflicts between the purchased ChowBig operating
system and software and any additional software application installations and
operations and hardware from non-ChowBig suppliers; Failure to
provide a suitable installation environment for the hardware system; Use of the
hardware system for purposes other than those for which it was designed;
Improper maintenance; Any other abuse, misuse, mishandling or misapplication
such as use of incorrect voltage, use of incorrect fuses, improper or
insufficient ventilation, failure to follow the manufacturer's user's manuals
that are provided by ChowBig;
WHAT ARE THE
LIMITATIONS OF YOUR COMPTOOLS WARRANTY?
There is no implied warranty of merchantability or
fitness beyond the one (1) year duration of this written warranty.
ChowBig, expressly disclaims all warranties not stated in this
warranty. There are no warranties which extend beyond the description on the
face hereof. Any implied warranties that may be imposed by law are limited to
the duration and terms of this warranty. Some states do not allow limitations on
how long an implied warranty lasts, so the above limitation may not apply to
you.
ChowBig shall not be liable for
any damages caused by its products or the failure of its products to perform,
including incidental and consequential damages, including but not limited to,
lost profits, lost savings, loss of use of the hardware system, loss use of
related equipment, cost of substitute or replacement equipment, "down time" or
injury to property. Under no circumstances shall ChowBig be
liable for incidental, consequential or other damages relating to or caused by
software.
Some states do not allow the exclusion or
limitation of incidental or consequential damages, so the above limitation or
exclusion may not apply to you.
WHEN DOES YOUR WARRANTY
PERIOD BEGIN?
Your sales invoice date is your purchase date for
purposes of commencing your warranty period. Your sales invoice is your proof of
the date of purchase. The warranty period is not extended as a result of
purchasing any additional products from ChowBig or upgrading
your presently owned ChowBig products. SHIPPING You must
pre-pay shipping and costs including insurance for any defective system or parts
returned under this warranty. ChowBig shall not be liable for
risk or loss or damage during shipment of your returned system or parts if you
fail to insure the shipment. For international shipping, you must pre-pay any
shipping charges, insurance, export taxes, custom duties and taxes including VAT
taxes or any other charges associated with transportation of your
ChowBig products. You assume the risk of loss. Replacement
products shall be new or serviceable used products, and are warranted for the
remainder of the warranty period or 15 days, whichever is
longer.
WHO IS
COVERED?
Your ChowBig warranty extends only
to you, the original purchaser. It is not transferable to anyone else who
receives the product from you whether by sale or other means.
WHAT DOES YOUR ChowBig LIMITED WARRANTY COVER?
During the first year of the warranty period,
ChowBig will at no additional charge, repair or replace
defective parts, at ChowBig sole discretion, with new parts or
at the option of ChowBig serviceable used parts that are
equivalent to new parts in performance. During the second and third years of the
warranty period, ChowBig will provide free or new or, at
ChowBig's sole discretion, serviceable used parts that are
equivalent to new parts in performance, but no labor to install parts. Any
service you choose, including ChowBig can do service during
this period.
All exchanged parts and hardware products replaced
under this warranty become the property of ChowBig. As to any
single claim, if after a reasonable number of attempts by
ChowBig, ChowBig is unable to restore the
hardware product to good working order by repair or replacement, you may request
a refund within warranty period in an amount not to exceed the purchase price,
excluding any shipping charges, provided the equipment covered under the
warranty has been returned to ChowBig pursuant to an RMA number
issued by ChowBig. Your request for refund as explained in this
paragraph must be in writting and sent to Comptools Computer at: 6510
New Utrecht Avenue, Brooklyn, NY 11219 by Certified Mail Return
Receipt Requested. These remedies are the purchaser's exclusive
remedy.
HOW DO YOU OBTAIN
WARRANTY SERVICE?
In order to obtain service under your
ChowBig warranty, please follow this procedure: Locate your
system serial number (sticker located on back of computer) and invoice number
and call 718-234-0045 to speak to a Technical Support Department representative.
The technical support staff will assist you in diagnosing the problem over the
phone. If the problem cannot be resolved over the phone, we will decide on the
best course of action for complete customer satisfaction. If you are not
satisfied that your claim has been resolved, then you must send a written claim
for technical assistance within the applicable warranty Period to: 6510 New Utrecht Avenue, Brooklyn, NY 11219 by Certified
Mail Return Receipt Requested or fax your claim request to 718-256-9531.
Telephone technical support service is limited to configuration and operation of
computer systems, sold by ChowBig as well as configuration of
operating system software installed by ChowBig on its computer
systems, for thirty (30) days from the date of shipment. This does not include
parts and components sold separately. 1. PARTS REPLACEMENT If the technical
support staff determines that a part is defective, a replacement can be sent to
you at our expense after you obtain a Return Merchandise Authorization (RMA)
number. You must call our technical support service at: 718-256-3976 to obtain
an RMA number before you attempt to return any part. Parts returned without
first obtaining an RMA number shall not be accepted, and in any case, shall not
be repaired or replaced.
ChowBig can send you the
replacement part before you return the defective part if you provide
ChowBig, with your valid credit card number to cover the cost
of the replacement. If ChowBig does not receive the defective
component within 14 days from date of delivery of new part, you will be charged
on your credit card for the cost of the component, and you will receive an
invoice from ChowBig. Please retain your shipping information,
including tracking number. This will serve as your proof of return. You can
still return the defective component for credit after 14 days, but you will be
charged a minimum 20% restocking fee. When you return the defective component it
must be freight prepaid and insured. Please write the rma number on the outside
of the package. After receiving the replacement component(s), please feel free
to call us if you need assistance in installation.
A replacement part will be sent to you after
ChowBig receives the defective part from you if you cannot
provide us with a valid credit card number.
ChowBig shall not be responsible
for failure of the delivery service to make on-time delivery. The technician
will give you a Return Merchandise Authorization (RMA) number for the
replacement part under warranty. Please write this RMA number on the package in
large, clear letters when returning the defective part.
If ChowBig determines that the
failure of the return parts was not the result of a defect in parts or
workmanship, ChowBig reserves the right to charge you for parts
and labor at the labor rate specified by ChowBig.
ChowBig will advise you prior to assessing these charges.
ChowBig shall not perform any such labor or provide any such
parts unless you provide written permission to perform the work
and/or replace parts at the prices and rates quoted to you by
ChowBig. If such written permission is not provided within 3
business days of notification that your claim does not result from defects in
ChowBig's parts and/or workmanship, your part(s)/system(s)
shall be returned to you at your expense. If shipping costs are not paid and the
system is returned to ChowBig, then you shall be charged for
such shipping costs and storage fees in the amount of $10.00 per day of
storage.
3 DAYS CONDITIONAL
MONEY BACK GUARANTY
If for any reason you are unsatisfied with your
purchase of ChowBig product, you may return the Product to
ChowBig within three 3 days of the shippment received date
for a full refund of your purchase price, less any restocking fee for, including
but not limited to, opened software, missing manuals, missing components, or
missing software license certificates or damage or alteration to the product.
Shipping charges and insurance are not included and will not be refunded to you.
Shipping charges and insurance must be paid by you. After 15 days, all
sales are final, and credit or refunds will not be given.
You must follow the conditions outlined below in
order to obtain your refund:
Before any return, an RMA number must be obtained
from ChowBig by calling 718-234-0045. The RMA number is
ChowBig authorization for you to return your parts / system.
The returned product must be clearly marked with the RMA Number on the label and
should be shipped in the original packaging, prepaid and insured by you in order
to prevent damage during shipping. Tracking numbers and all other shipping
information must be retained by you until you have been credited for the return
by ChowBig.
To receive a refund, the returned product must be
received at our factory within ten (10) days from the date that the RMA is
issued and within (25) days from the purchase date. If your product is not
received within ten (10) days of the RMA being issued, but it is received
within (25) days of your purchase date, then you shall be charged 20% of
your invoice amount as a restocking fee. If your product is not received
within (25) days of your purchase date, then you shall not be entitled to
any refund. Upon ChowBig receipt of your returned product and
verification that the same has not been damaged, altered or is missing parts,
manuals, components or software license certificates or that software has been
opened, you will receive a full refund normally within fourteen (14) days from
the date the system is received. For products purchased with a credit card, the
refund will be paid by issuing a credit on your credit card. Your refund amount
may be reduced for opened software, missing manuals, missing components, or
missing software license certificates or damage or alteration to the product.
ChowBig will not accept any unauthorized returns. Any
merchandise returned without first obtaining an RMA number shall be rejected and
returned to you at your expense. If shipping costs are not paid and the system
is returned to ChowBig, then you shall be charged a storage
rate in the amount of $10.00 per day of storage.
HOW DOES STATE LAW
RELATE TO THIS WARRANTY?
This warranty gives you specific legal rights, and
you may also have other rights which vary from State to State. JURISDICTION AND
VENUE You and ChowBig agree that this warranty, its
interpretation and any disputes arising from this warranty shall be exclusively
governed by the laws of the State of New York and applicable federal laws. It is
mandatory that all disputes arising from or relating to this warranty, or any
agreement arising out of the acceptance thereof, shall he commenced and tried
exclusively in the New York Supreme Court, New York County in the State of New
York, USA except in the case where such disputes must be tried in United States
federal courts in which case it is mandatory that such disputes shall be
commenced and tried in the United States District Court for the Southern
District of New York.
SCOPE OF WARRANTY
AGREEMENT
This writing contains the total agreement of you
and ChowBig and all agreements entered into prior to or
contemporaneously with the execution of this agreement are excluded whether oral
or in writing. No oral or written information, including but not limited to, the
three (3) day money back guaranty, or advice given by Comptools its agents or
employees shall create a warranty or in any way increase the scope of this
warranty.
